Welcome to CheckForPhishing.com! CheckForPhishing.com is a web-based toolkit dedicated to prevent phishing. Our tool(s) are free to use but will alwayes remain property of the "Check for Phishing" owners.
These Terms and Conditions of Service ("Terms") apply to and govern your access to and use of the services available from the domain and sub-domains of Check for Phishing, which includes checkforphishing.com and all its other branded websites, software, platforms, applications (collectively, the "Software"), and/or services (the Software and/or services are collectively referred to herein as the "Service"). Please review these Terms carefully, including the arbitration provision, which describes how disputes will be resolved between us, and note that no class actions may be brought under these Terms.
Your Use of the ServiceBy accessing or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organization or entity ("Organization"), then you are agreeing to these Terms on behalf of that Organization and you represent and warrant that you have the authority to bind the Organization to these Terms. In that case, "you" and "your" refers to you and that Organization.
You may use the Service only if you can form a binding contract with CheckForPhishing.com, and only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations. The Service may change from time to time as features of the Service are added, removed and/or modified, with or without notice to you. In addition, CheckForPhishing.com may temporarily or permanently stop providing the Service, or any features within the Service, to you or to users generally and may not be able to provide you and/or the Organization with prior notice, which you agree is not required.
You rely on any site content, information, or advice provided through the Service at your own risk. Please see below for more information on CheckForPhishing.com limitations on liability in regards to Service content.
Your ContentSome areas of the Service may allow you to post or upload information, data, text, graphics, or other material ("Content" or, when posted by you, "your Content"). You retain ownership of your Content. Please consider carefully what you choose to upload to the Service.
You agree not to upload or post any Content that: (i) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal; (ii) may create a risk of any other loss or damage to any person or property (including our Software or the software of any third parties); (iii) seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise; (iv) may constitute or contribute to a crime or tort; (v) contains any information or content that may be unlawful, harmful, abusive, discriminatory, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise potentially civilly and/or criminally actionable; (vi) contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another partys trade secrets); (vii) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; (viii) promotes, encourages, or engages in any spam or unsolicited bulk email, or computer or network cracking or hacking; or (ix) contains any information or content that you know is misleading, deceptive, incorrect and/or no longer current. You agree that any Content that you post or upload does not and will not violate rights of any kind, including without limitation any intellectual property rights or rights of privacy. We reserve the right, but are not obligated, to reject and/or remove any Content that we believe, in our sole discretion, violates any part or all of these provisions.
We reserve the right at all times, but are not obligated, to, in our sole discretion, remove or refuse to distribute any Content on the Service including your Content. We also reserve the right, in our sole discretion, to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of CheckForPhishing.com, its users and the public.
In creating your user name, we retain the right to refuse to register any user name that includes the name or any other specific information that is uniquely associated with a specific business, provider, expert, professional, or other individual or entity if the user seeking to register the name in fact is not the specific individual or entity in question. CheckForPhishing.com reserves the right to require users to re-register user names as necessary to observe the foregoing limitation.
Each CheckForPhishing.com user may have only one user account.
If you provide personal information to us directly, you acknowledge and agree that you have the necessary rights and permissions to share all information necessary to initiate the Services with CheckForPhishing.com. You acknowledge and agree that the Services may be provided by independent contractors or third party service providers
You may not engage in advertising to, or solicitation of, other Service users. This includes but is not limited to solicitation or advertising to buy or sell any products or services through the Service, or invitations to attend parties or other social functions or networking events for commercial purposes or any other purpose that could be deemed competitive to CheckForPhishing.com Services. You may not transmit any chain letters or junk email to other Service users. Although CheckForPhishing.com cannot monitor the conduct of its Service users offline, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Service user without their prior exp licit consent. In order to protect our Service users from such advertising or solicitation, we reserve the right to restrict the number of messages which a Service user may send to other Service users in any 24-hour period to a number which we deem appropriate in our sole discretion. No user may use an account for the purpose of spamming or soliciting CheckForPhishing.com users.
You may not transfer your CheckForPhishing.com account to another user.
You are solely responsible for your interactions with other Users. We reserve the right, but have no obligation, to moderate exchanges between users; provided however, that CheckForPhishing.com will have no liability for your interactions with other users, or for other users interactions with you.
Account SecurityCheckForPhishing.com is responsible for providing a secure method of authentication and accessing its Service. CheckForPhishing.com will provide mechanisms that allow for user password management, transmit passwords in a secure format, and protect passwords entered for purposes of gaining access to the Service by utilizing code that follows password management best practices. You will be responsible for protecting the security of usernames and passwords, or any other codes associated to the Service, and for the accuracy and adequacy of personal information provided to the Service. You will implement policies and procedures to prevent unauthorized use of usernames and passwords, and will promptly notify CheckForPhishing.com upon suspicion that a username and password has been lost, stolen, compromised, or misused.
At all times, CheckForPhishing.com, and any third party vendors and hosting partners it utilizes to provide the Service, will: (a) use information security best practices for transmitting and storing your Content, adhering to industry standards; (b) employ information security best practices with respect to network security techniques, including, but not limited to, firewalls, intrusion detection, and authentication protocols, vulnerability and patch management; and (c) ensure its host facilities maintain industry standards for security and privacy.
CheckForPhishing.com shall report to you, with all relevant details (except those which could prejudice the security of data uploaded by other customers), any event that CheckForPhishing.com reasonably believes represents unauthorized access to, disclosure of, use of, or damage to Content (a "Security Breach"). CheckForPhishing.com shall make such report within 72 hours after learning of the Security Breach. In the event of a Security Breach, CheckForPhishing.com shall (a) cooperate with you to identify the cause of the breach and to identify any affected Content; (b) assist and cooperate with you in investigating and preventing the recurrence of the Security Breach; (c) assist and cooperate with you in any litigation or investigation against third parties that you undertake to protect the security and integrity of Content; and (d) use commercially reasonable endeavors to mitigate any harmful effect of the Security Breach.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions taken in connection with your password, whether your password is with CheckForPhishing.com or a third-party service. We encourage you to use "strong" passwords that use a combination of upper and lower case letters, numbers and/or symbols, as permitted, with your account. You agree not to disclose your password to any third party. CheckForPhishing.com cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements. You, however, may be liable for any loss CheckForPhishing.com or others incur caused by your account, whether caused by you, or by an authorized person, or by an unauthorized person. You must notify CheckForPhishing.com immediately upon becoming aware of any breach of security or unauthorized use of your account.
It is a condition of your use of this site that all the information you provide on through the Services will be correct, current and complete. CheckForPhishing.com has the right to refuse you access to the Services, and to terminate your access at any time. You are solely responsible for the activity that occurs on your account, whether authorized by you or not, and you must keep your account information secure.
Availability of Website and ServicesSubject to the terms and conditions of these Terms and our other policies and procedures, we shall use commercially reasonable efforts to attempt to provide the Services on a twenty-four (24) hours a day, seven (7) days a week basis. You acknowledge and agree that from time to time the Services may be inaccessible or inoperable for any reason including, but not limited to, equipment malfunctions; periodic maintenance, repairs or replacements that we undertake from time to time; or causes beyond our reasonable control or that are not reasonably foreseeable including, but not limited to, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion or other failures. You acknowledge and agree that we have no control over the availability of the Service on a continuous or uninterrupted basis, and that we assume no liability to you or any other party with regard thereto.
CheckForPhishing.com License to YouSubject to these Terms, CheckForPhishing.com gives you a limited, personal, non-transferable, non-assignable, non-sublicensable, non-commercial, worldwide, royalty-free, non-exclusive and revocable license to use the Service. We reserve all rights not expressly granted in these Terms in the Service. We may terminate this license at any time, with or without notice, for any reason or for no reason at all. Except to the extent that such restrictions may be expressly prohibited by law, you may not: (i) modify, disassemble, decompile or reverse engineer the Software; (ii) rent, lease, loan, resell, sublicense, distribute or otherwise transfer the Software to any third party or use the Software to provide time sharing or similar services for any third party; (iii) make any copies of the Software; (iv) remove, circumvent, disable, damage or otherwise interfere with security-related features of the Software, features that prevent or restrict use or copying of any content accessible through the Software, or features that enforce limitations on use of the Software; or (v) delete the copyright and other proprietary rights notices on the Software. You agree that we may from time to time issue upgraded versions of the Software, and may automatically electronically upgrade the version of the Software that you are using. You agree to the automatic upgrading, and agree that these Terms will apply to any upgrades. Any third-party code that may be incorporated in the Software is covered by the applicable open source or third-party license and/or end-user license agreement (EULA), if any, authorizing use of such code. This license is not a sale of the Software or any copy thereof, and CheckForPhishing.com or its third party partners or suppliers retain all right, title, and interest in the Software (and any copy thereof).
This license does not include any right to resell or make commercial use of CheckForPhishing.com or any Content, including without limitation any collection and use of any product listings, descriptions, or prices, any derivative use of this site or its contents, any downloading or copying of account information for the benefit of another merchant, or any use of data mining, robots, or similar data gathering and extraction tools.
You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of CheckForPhishing.com provided that the link does not portray CheckForPhishing.com, its associates, or our products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any CheckForPhishing.com logo or other proprietary graphic or trademark as part of the link without CheckForPhishing.com express written permission.
We may make available software to access the Service via a mobile device ("Mobile Software"). To use the Mobile Software you must have a mobile device that is compatible with the Mobile Service. We do not warrant that the Mobile Software will be compatible with your mobile device. We give you a limited, personal, non-transferable, non-assignable, non-sublicensable, non-commercial, worldwide, royalty-free, non-exclusive and revocable license to use a compiled code copy of the Mobile Software for one account on one mobile device owned or leased solely by you, for your personal use. Except to the extent that such restrictions may be expressly prohibited by law, you may not: (i) modify, disassemble, decompile or reverse engineer the Mobile Software; (ii) rent, lease, loan, resell, sublicense, distribute or otherwise transfer the Mobile Software to any third party or use the Mobile Software to provide time sharing or similar services for any third party; (iii) make any copies of the Mobile Software; (iv) remove, circumvent, disable, damage or otherwise interfere with security-related features of the Mobile Software, features that prevent or restrict use or copying of any content accessible through the Mobile Software, or features that enforce limitations on use of the Mobile Software; or (v) delete the copyright and other proprietary rights notices on the Mobile Software. You agree that we may from time to time issue upgraded versions of the Mobile Software, and may automatically electronically upgrade the version of the Mobile Software that you are using on your mobile device. You agree to the automatic upgrading on your mobile device, and agree that the terms and conditions of these Terms will apply to any upgrades. Any third-party code that may be incorporated in the Mobile Software is covered by the applicable open source or third-party license EULA, if any, authorizing use of such code. This license is not a sale of the Mobile Software or any copy thereof, and CheckForPhishing.com or its third party partners or suppliers retain all right, title, and interest in the Mobile Software (and any copy thereof).
The Software and/or the Mobile Software originate in the Netherlands, and is/are subject to the Netherlands export laws and regulations. The Software and/or the Mobile Software may not be exported or re-exported to certain countries or those persons or entities prohibited from receiving exports from the Netherlands. In addition, the Software and/or the Mobile Software may be subject to the import and export laws of other countries. You agree to comply with all Netherlands and foreign laws related to use of the Software and/or the Mobile Software and the Service.
For all purposes, we reserve all rights not expressly granted under these Terms.
Intellectual Property, Copyrights and FeedbackAll right, title, and interest in and to the Service (excluding Content provided by users) are and will remain the exclusive property of CheckForPhishing.com and its licensors. The Service is protected by copyright, trademark, and other laws of both The Netherlands and foreign countries. Nothing in the Terms gives you a right to use the CheckForPhishing.com name, or any of the CheckForPhishing.com trademarks, logos, domain names, and/or other distinctive brand features.
Any feedback, comments, or suggestions you may provide regarding CheckForPhishing.com, or the Service is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit, and without any obligation to you.
Use of ContentAll Content in or on the Service, whether publicly posted or privately transmitted by users, is the sole responsibility of the person who originated such Content. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Service or endorse any opinions expressed via the Service. We may or may not monitor and/or control the Content posted via the Service, as we alone determine in our sole discretion, and we do not accept and specifically disclaim any responsibility for such Content. Acceptable Use of the ServiceCheckForPhishing.com is trusted by its users, and we trust you to use the Service responsibly. You agree not to misuse the Service. For example, you must not, and must not attempt to do the following things:

International users agree to comply with all local laws regarding online conduct and acceptable content.
We may investigate and/or suspend your account if you violate any of the above rules. Furthermore, we reserve the right to immediately terminate your account without further notice in the event that, in our sole and absolute judgment, you violate these Terms, or abuse the use of our Service.
Additional Reservation of RightsCheckForPhishing.com expressly reserves the right to deny, cancel, terminate, suspend, lock, or modify access to (or control of) any account or Services for any reason (as determined by CheckForPhishing.com in its sole and absolute discretion), including but not limited to the following: (i) to correct mistakes made by CheckForPhishing.com in offering or delivering any Services, (ii) to protect the integrity and stability of our Services, (iii) to assist with our fraud and abuse detection and prevention efforts, (iv) to comply with court orders against you and applicable local, state, national and international laws, rules and regulations, (v) to comply with requests of law enforcement, including subpoena requests, (vi) to comply with any dispute resolution process, (vii) to defend any legal action or threatened legal action without consideration for whether such legal action or threatened legal action is eventually determined to be with or without merit, or (viii) to avoid any civil or criminal liability on the part of CheckForPhishing.com, its officers, directors, employees and agents, as well as CheckForPhishing.coms affiliates, including, but not limited to, instances where you have sued or threatened to sue CheckForPhishing.com.
Electronic CommunicationsWhen you visit CheckForPhishing.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on CheckForPhishing.com. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
PrivacyWe care about the privacy of our users. You can browse our site without telling us who you are or revealing any personal information about yourself. Once you create an account, which requires that you provide us your name and email address, you are not anonymous to us. We also may collect demographic information such as your zip code, preferences and interests and other information relevant to customer surveys and/or offers. If you choose to provide us with this or any other personal information, you consent to the storage and transfer of that information on our servers, which may be located in The Netherlands or abroad.
SMTP, Socket and PortScan Connection AttemptsThe signature of some of our tests, look similar to open relay scans that a spammer might perform. Other tests such as TCP, HTTP and Port Scans have similar markers. You agree that you will only run these tests against servers that you are responsible for and that you are authorized to run these tests against those servers.
DMCA Notice and PolicyWe respect others' intellectual property rights and we ask that you do too. We will respond to notices of alleged copyright infringement if they comply with the law and are properly provided to us through our DMCA policy, which is as follows:
We respect artist and content owner rights and we expect our users to do the same. It is our policy to respond to claims of infringement in compliance with the Digital Millennium Copyright Act of 1998. UNDER FEDERAL LAW, IF YOU KNOWINGLY MISREPRESENT THAT ONLINE MATERIAL IS INFRINGING, YOU MAY BE SUBJECT TO CRIMINAL PROSECUTION FOR PERJURY AND CIVIL PENALTIES, INCLUDING MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS' FEES.
Please be aware that this procedure is only for notifying us that your copyrighted material has been infringed. The preceding requirements are intended to comply with our rights and obligations under the DMCA, including 17 U.S.C. 512(c), but do not constitute legal advice.

Third PartiesFrom time to time, in connection with certain Services, CheckForPhishing.com references lists and databases maintained by unrelated third parties. More specifically, we provide online tools which allow you to look up information from openly available third party databases, using standard open query protocols ("Queries") including but not limited to DNS, WHOIS and Rsync, which are designed to promote the free exchange of information to support Internet technical operations (please note that we do not "screen scrape" any third party websites for information and only use open query protocols designed to allow automatic and programmatic access to the database information). For example, in order to determine if your server has been blacklisted or "blocklisted" by spam-monitoring organizations, we access such lists, and pass the results on to you. CheckForPhishing.com DOES NOT REFER NAMES OR IP ADDRESSES TO THIRD PARTY BLACKLISTS OR BLOCKLISTS AND HAS NO PLANS TO DO SO IN THE FUTURE. We provide a service that informs you if you have been included on the lists of third parties so that you may work with such third parties to remedy the situation. CheckForPhishing.com IS NOT RESPONSIBLE FOR ANY ACTIONS OF THIRD PARTIES, INCLUDING ANY HARM TO YOU OR YOUR ORGANIZATION ARISING OUT OF YOUR INCLUSION ON ANY BLOCKLIST OR BLACKLIST OF ANY THIRD PARTY. Not withstanding the foregoing paragraph, CheckForPhishing.com is not affiliated with websites or third parties that sell or advertise our services or provides services without a written agreement with us. CheckForPhishing.com reserves the right to void all service policies, return policies, and other policies for orders and CheckForPhishing.com products or services that were obtained through unauthorized parties. CheckForPhishing.com is not responsible for any representations by unauthorized parties.
IndemnificationYou agree to defend, indemnify and hold harmless CheckForPhishing.com and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, including any data or Content transmitted or received by you, any other party's access or use of the Service with your username and password, or your violation of these Terms, applicable law, rule or regulation.
Changes to TermsWe may revise these Terms from time to time, with or without prior notice. We will post the most current version of these Terms on our website. If a revision, in our sole discretion, is material we may, but need not, in our sole discretion, notify you (for example by email to the email address associated with your account). Other changes may be posted to our blog or Terms page, so please check those pages regularly. You agree that the Service is based in The Netherlands; and these Terms are governed by the internal substantive laws of the Netherlands, without respect to its conflict of laws principles.
